1. INTRODUCTION

This Privacy Notice for Neylyzer ("we," "us," or "our"), describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

  • Download and use our mobile application (Neylyzer), or any other application of ours that links to this Privacy Notice.
  • Engage with us in other related ways, including any marketing or events

Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed.

If you do not agree with our policies and practices, please do not use our Services.

2. WHAT INFORMATION DO WE COLLECT?

Personal Information Provided by You.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use.

The personal information we collect may include the following:
Account Information: When you create an account, we collect your name, email address, username, password, user ID, and optional profile picture.

User-Generated Content: We collect content you create, including research threads and AI conversations, posts, comments, direct messages, and uploaded documents (PDFs, images) for AI analysis. As well as community information such as subscriptions, replies, likes, dislikes, favourites, followers, follows, direct messages, and other content associated with your account.

Subscription and Purchase Data: We collect subscription status, billing cycle, purchase history, and usage counts. Payments are processed by official Apple App Store or Google Play Store; we do not store payment card details. All payment data is handled and stored by Apple Inc. and Google LLC. You may find their privacy notice link(s) here: https://www.apple.com/legal/privacy/ and https://policies.google.com/privacy.

Information collected automatically.

Application data. If you use our mobile application, certain information is collected or processed automatically as described below.

  • Device and technical data. To run the Services, your device communicates with our servers over the internet. As part of that connection, standard network and technical information may be processed automatically by us and our hosting providers (for example, internet protocol (IP) addresses, date/time of requests, and information typically found in server or load-balancer logs). To deliver push notifications, we associate your account with a push notification token and record whether the device is iOS or Android so we can send notifications to the correct installation. We do not use our application to collect your hardware model, manufacturer, advertising identifier, or a persistent hardware “device ID” for analytics or profiling.
  • Third-party SDKs. Our app integrates providers (for subscription and in-app purchase management) which may automatically receive or generate device- and app-related technical identifiers and data needed to provide their services (for example, to route push messages or validate purchases). How they process information is described in their respective policies. For more information, get in touch with us using the contact us section.
  • Push notifications. We may ask for permission to send you push notifications about your account or features of the app (for example, messages, social activity, or alerts for companies). You can turn off push notifications at any time in your device settings (and, on some platforms, in the app’s notification settings).
  • Links opened in the app. In limited cases, content may be opened using your device’s in-app browser or web view. If you visit a third-party website that way, that site’s own terms and privacy policy apply to information collected there.

Why we use this information. We use automatically collected or processed information to operate and secure the Services, deliver push notifications you have enabled, support subscriptions and purchases through the app stores, troubleshoot issues, and maintain reliable service between your device and our systems.

3. HOW DO WE PROCESS YOUR INFORMATION?

We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service, including processing your queries, prompts, and uploaded documents to generate AI-powered financial research and insights.
  • To manage your subscriptions and in-app purchases. We may process your information to manage your subscription status, usage limits, and billing cycles. Please note that all payments are processed securely by the Apple App Store or Google Play Store; we do not directly process or store your credit card information.
  • To enable user-to-user communications. We may process your information if you choose to use any of our offerings that allow for communication with another user (such as direct messages, social feed posts, and comments).
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information via email or push notifications.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring, enforcing our Terms of Service, and providing user blocking features.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends (such as trending financial questions), determine the effectiveness of our features, and to evaluate and improve our Services and user experience.
  • To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

4. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law. Depending on your location, we rely on the following legal bases to process your information:

  • Consent: We may process your information if you have given us permission (i.e., express or implied consent) to use your personal information for a specific purpose (for example, to send you push notifications). You can withdraw your consent at any time.
  • Performance of a Contract: We process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing our Services or taking steps at your request prior to entering into a contract with you (for example, creating your account, managing your subscriptions, or processing your AI queries).
  • Legitimate Interests: We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information to analyse usage trends, protect our Services from fraud and abuse, and maintain the integrity of our community guidelines.
  • Legal Obligations: We may process your information where we believe it is necessary for compliance with our legal obligations, such as cooperating with a law enforcement body or regulatory agency, exercising or defending our legal rights, or disclosing your information as evidence in litigation in which we are involved.

If you are located in Canada, this section applies to you:

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way.
  • For investigations and fraud detection and prevention.
  • For business transactions provided certain conditions are met.
  • If we have reasonable grounds to believe an individual has been, is, or may be the victim of financial abuse.
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province.
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records.
  • If the information is publicly available and is specified by the regulations.

5. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We may share information in specific situations described in this section and/or with the following categories of third parties:

  • Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. The categories of third parties we may share personal information with include:
  • Artificial Intelligence (AI) Service Providers: We share your queries, prompts, and uploaded documents with third-party AI and machine learning providers to generate the financial research, analysis, and insights provided by our Services.
  • Payment & Subscription Processors: We share necessary account identifiers with app stores and subscription management platforms to validate, manage, and track your subscription status and in-app purchases.
  • Cloud Computing & Infrastructure Providers: We use third-party hosting and cloud services to store your data securely, run our servers, and deliver push notifications to your device.
  • Other Users. When you share personal information (for example, by posting financial research threads, comments, replies, or other content to the Services) or otherwise interact with public areas of the Services, such personal information may be viewed by all users and may be publicly made available outside the Services in perpetuity. Similarly, other users will be able to view your public profile, your followers/following lists, your engagement (likes, dislikes, favorites), and communicate with you directly within our Services.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Legal Obligations and Rights. We may disclose your personal information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements). We may also disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, or situations involving potential threats to the safety of any person.

6. AGGREGATED and PUBLIC FACING INFORMATION.

Aggregated and De-Identified Data: We may aggregate or de-identify information collected through the Services so that it cannot reasonably be used to identify you. We use this aggregated data for analytics, service improvement, identifying market trends (such as generating our "Trending Questions" feature), and other lawful business purposes.

Public-Facing Information: Certain parts of the Service are public by design. When you engage with the community features of our app, your username, public profile picture, posts, comments, likes, dislikes, followers, following lists, and other public interactions may be visible to other users and the general public.

AI Research Threads: Your individual AI research threads are private by default. However, if you explicitly choose to share a research thread to the public community feed, that specific content becomes public-facing and will be visible to other users, including any uploaded content such as PDFs and images.

As part of our Services, we offer features and tools powered by artificial intelligence, machine learning, or similar technologies ("AI Features"). These tools are designed to provide you with financial research, natural language processing, image analysis, and insights.

Use of AI Technologies: We provide these AI Features through secure, enterprise-grade third-party AI service providers. When you use our AI Features, your inputs (such as prompts, queries, and uploaded documents) and the resulting outputs are processed by these providers solely to deliver the requested service to you.

Our Al Products are designed for the following functions:

◦    Natural language processing

◦    Al insights

◦    Al web search

Data Privacy and Training: We maintain strict data privacy agreements with our enterprise AI service providers. Your personal information, uploaded documents, and private research queries are not used by these third-party providers to train their foundational machine learning models. All data processed through our AI Features is handled in strict accordance with this Privacy Policy to ensure your information remains secure and confidential.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

Active Accounts: No purpose in this policy will require us keeping your personal information for longer than the period of time in which you have an active account with us.

Account Deletion and Backups: When you request to delete your account, your personal information, user-generated content, and engagement data are immediately deleted from our active databases. However, please note the following exceptions:

  • Fraud Prevention: To prevent abuse of our Services, enforce our Terms of Service, and prevent spam, we may securely retain certain account identifiers for a limited period following account deletion to prevent unauthorized re-registration.
  • Backup Archives: Your personal information may remain in our encrypted database backup archives for a limited time due to our automated disaster recovery systems. This backup data is securely isolated, is not used for any further processing, and is automatically overwritten and permanently deleted at the end of the backup retention cycle.

When we have no ongoing legitimate business need to process your personal information, we will delete or anonymize such information.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. For example, we use secure cloud infrastructure, encrypt data in transit, and rely on industry-standard payment processors (Apple and Google) so that we never process or store your raw credit card information.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment. Furthermore, you are responsible for ensuring the confidentiality of your account credentials and for using a strong, unique password.

International Data Transfers: Your data may be processed and stored in countries other than your own, including the United States, where our primary servers and third-party service providers are located. By using our Services, you acknowledge and consent to such transfers. We ensure appropriate safeguards are in place to protect your data during these transfers in accordance with applicable laws.
